Chapter 1: General Provisions

Article 1 (Purpose)

These Terms of Service (the “Terms”) aim to stipulate the rights, obligations, responsibilities, and other necessary matters between Floater Lab (the “Company”) and the user (the “User”) in connection with the use of the emo application and all related services (the “Service”).

Article 2 (Definitions)

  1. “Service” refers to the emo application provided by the Company and any associated translation and information services (including updated versions).

  2. “User” refers to a customer who accesses or uses the Service in accordance with these Terms.

  3. “Content” refers to menu images and all data included therein that the User captures or uploads while using the Service.

Article 3 (Posting and Amendment of Terms)

  1. The Company shall post these Terms within the Service menu or on its website so that Users can easily access them.

  2. The Company may amend these Terms to the extent that such amendments do not violate relevant laws and regulations.

  3. The Company may require Users to consent to the updated Terms in a specific manner before continued use of the Service is permitted; if a User continues to use the Service after the effective date of the amended Terms, such use shall be deemed as acceptance of the modified Terms.

Chapter 2: Service Use and Data Policy

Article 4 (Formation of Agreement and Age Restriction)

  1. This Service is available without a separate registration process. By using the app, the User is deemed to have agreed to these Terms.

  2. Age Restriction: This Service is intended for individuals aged fourteen (14) and older. Any consequences arising from the use of the Service by a minor under the age of 14 in violation of this provision shall be the sole responsibility of the legal guardian of such minor.

Article 5 (Provision, Updates, and Advertisements)

  1. The Company provides menu translation services to the User. The Company may grant additional usage rights upon the condition of viewing advertisements after a certain number of uses.

  2. Evolution of Service: The User acknowledges that the Service is continuously evolving. The Company may require or perform automatic updates without prior notice for purposes such as security enhancements or functional improvements.

Article 6 (Ownership)

  1. Ownership of Content: The copyright of the “Content” uploaded by the User remains with the User.

  2. License Grant: By uploading Content, the User grants the Company a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, edit, store, and create derivative works of such Content for AI training and Service improvement purposes.

  3. Feedback: Any suggestions, ideas, or feedback provided by the User to the Company shall be considered non-confidential. The Company shall have the right to use such feedback for any purpose without any obligation or compensation to the User.

  4. Trademarks: All graphics, logos, and trade names used in the Service are protected and may not be used without prior written permission from the Company.

Chapter 3: User Obligations and Restrictions

Article 7 (User Obligations and Prohibited Conduct)

The User shall not engage in any of the following acts. In the event of a violation, the Company may immediately block or terminate the User's access to the Service:

  1. Uploading images that infringe upon the intellectual property rights (copyrights, portrait rights, etc.) of others;

  2. Prohibition of Scraping: Accessing, collecting, duplicating, or extracting data, content, or translation results from the Service using automated means (scripts, robots, spiders, scrapers, etc.) without authorization;

  3. System Interference: Circumventing security features or imposing an unreasonable load on the servers (including the introduction of viruses, worms, or other harmful code) that interferes with the normal operation of the Service;

  4. Reverse Engineering: Attempting to reverse engineer, decompile, or extract the source code of the Service software.

Chapter 4: Limitation of Liability (IMPORTANT)

Article 8 (Limitation of Liability and Indemnification)

  1. Limitations of AI Translation: Translation results are provided for reference purposes only via AI technology and do not guarantee 100% accuracy. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

  2. Order and Health Disclaimer: Users MUST directly verify health and safety-related information (such as allergy information) with the restaurant. The Company shall not be liable for any ordering errors, physical injuries, or economic losses resulting from mistranslations.

  3. Price and Currency Information: Menu prices and currency conversion information displayed within the Service are estimates for reference only and may differ from actual restaurant prices or real-time exchange rates. The Company is not responsible for any disputes related to payments arising from such discrepancies.

  4. Third-Party Ads and Services: The Company shall not be liable for any damages arising from information provided by third parties, such as advertisements displayed within the Service, unless caused by the Company’s willful misconduct or gross negligence.

  5. Responsibility for Decisions: The final decision regarding any order or use of the Service rests solely with the User. The Company is indemnified from any outcomes resulting from the User’s negligence or misunderstanding of information.

  6. Force Majeure: The Company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, riots, or telecommunication failures.

Chapter 5: Miscellaneous

Article 9 (International Users)

The Service is controlled and offered by the Company from its facilities in the Republic of Korea. Users who access or use the Service from other jurisdictions are responsible for compliance with their local laws. The Company makes no representations that the Service is appropriate or compliant in all locations.

Article 10 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.

  2. Any legal action or proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
